This is the latest news from USCIS regarding H-1B cap cases. Unfortunately, the news is not good.
The H-1B cap for fiscal year 2008 has already been reached.
As of Monday afternoon, USCIS reports it had received 150,000 cap-subject H-1B petitions.
As a reminder, there are 65,000 H-1B visa numbers available. There are also 20,000 separate numbers available for H-1 applicants with a U.S. Master's degree or higher. USCIS cannot yet tell how many of the H-1 filings will use a "Master's number" instead of a visa number from the general pool.
USCIS will conduct a "computer-generated random selection process" (basically a lottery) to determine which H-1 filings will receive an available H-1 visa number. By regulation, any H-1s that USCIS received on both April 2 and April 3 will be included in the lottery. Due to the extremely high number of H-1 filings, "USCIS will not be able to conduct the random selection for several weeks."
Doing a quick scan of these numbers, it appears any H-1 we filed (including yours) has roughly a 1 in 3 chance of obtaining an H visa number. That's just a guess at this point.
