🔑 The TN visa does not allow "dual intent," but the H-1B does.
1. TN visa = Non-immigrant intent only
The TN visa (under NAFTA/USMCA) is a non-immigrant visa, which means:
You must intend to return to your home country after your TN employment ends.
Applying for a green card (which shows immigrant intent) can jeopardize your TN status.
You may be denied TN renewals or re-entry if you are known to be pursuing a green card.
2. H-1B visa = Dual intent allowed
The H-1B visa is also a non-immigrant visa but allows "dual intent":
You can legally pursue a green card while on H-1B.
USCIS and CBP won’t penalize you for applying for permanent residency.
You can stay in the U.S. for up to 6 years on H-1B, which usually gives enough time for green card processing.
